Welcome to Spin My Party LLC (“Spin My Party,” “we,” “our,” or “us”). These Terms and Conditions apply to photo booth rentals, event enhancements, add-ons, customized setups, and related services provided by Spin My Party.
By approving a proposal, signing an agreement, submitting payment, or booking services with Spin My Party, the person or organization making the reservation (“Client,” “you,” or “your”) acknowledges and agrees to these Terms and Conditions.
1. Booking & Reservation
A non-refundable booking deposit is required to reserve an event date unless otherwise stated in your proposal, invoice, or booking agreement.
An event date is not considered reserved until Spin My Party has received the required booking deposit and any required signed or electronically approved agreement or proposal.
Submitting an inquiry, requesting a quote, receiving a proposal, or discussing availability does not reserve an event date.
Drop & Go services require full payment at the time of booking unless otherwise stated.
2. Payment Terms
Unless otherwise specified in your proposal, invoice, or booking agreement:

The required booking deposit is due at the time of booking and is non-refundable.

The remaining balance is due no later than 30 calendar days before the scheduled event date.

Events booked fewer than 30 days before the event date require payment in full at the time of booking.

Drop & Go services require payment in full at the time of booking.

Add-ons, upgrades, additional rental time, customizations, or other services added after the original booking may require additional payment and may have separate payment deadlines.

All balances must be paid in full before Spin My Party provides services at the event.
Accepted payment methods may include credit/debit card, Apple Pay, PayPal, or cash. Checks are not accepted.
Failure to make the final payment by the required deadline may result in cancellation of services and forfeiture of the booking deposit.
3. Cancellations
The booking deposit is non-refundable because the event date is reserved specifically for the Client and may prevent Spin My Party from accepting other bookings.
For cancellations made 30 or more calendar days before the scheduled event, payments made beyond the non-refundable booking deposit may be refunded, less any non-refundable custom expenses, materials, or products already purchased or produced specifically for the event.
Cancellations made fewer than 30 calendar days before the scheduled event are not eligible for a refund of amounts already paid.
Custom products, personalized materials, special-order items, custom backdrops, props, printed materials, or other items created or purchased specifically for an event are non-refundable once production or purchasing has begun.
4. Rescheduling
Requests to reschedule are subject to availability and must be approved by Spin My Party.
When a rescheduling request is received at least 30 days before the original event date, payments may be transferred to a new available date at Spin My Party's discretion.
Rescheduling requests received fewer than 30 days before the scheduled event may require a new booking deposit.
Pricing, availability, and services may change when an event is moved to a different date, location, venue, or time.
5. Event Changes, Customizations & Add-Ons
Clients are welcome to request changes, upgrades, and additional services after booking.
All additions and modifications are subject to availability. Additional charges will be added to the Client's invoice and must be paid by the deadline provided by Spin My Party.
Major changes to the event date, location, venue, operating hours, setup requirements, or selected services may result in additional charges.
Customizations and special-order items may have earlier deadlines. Spin My Party cannot guarantee that customization requests submitted close to the event date can be accommodated.
Once custom items have been ordered, created, printed, personalized, or placed into production, those items and associated charges are non-refundable.
6. Event & Venue Requirements
The Client is responsible for providing accurate event information and ensuring that Spin My Party is permitted to provide the contracted services at the venue.
Unless otherwise agreed, the Client is responsible for ensuring appropriate and timely access to the venue for delivery, setup, operation, and breakdown.
For services requiring electricity, the Client must provide access to a functioning standard 110V electrical outlet within a reasonable distance of the setup area.
The Client is responsible for informing Spin My Party in advance of stairs, elevators, restricted loading areas, long-distance equipment transport, limited parking, venue access restrictions, or other conditions that may affect setup or breakdown.
Additional charges may apply when unusual venue conditions require additional labor, equipment, parking, transportation, or setup time.
7. 360 Photo Booth Requirements
For safe and proper operation of the 360 Photo Booth, the Client must provide:

A reasonably level, stable, and appropriate surface.

Approximately 10 ft. × 10 ft. of unobstructed operating space, unless another setup arrangement has been approved in advance.

Access to an appropriate standard 110V electrical outlet.

Adequate access for equipment delivery, setup, and removal.

Appropriate overhead protection for outdoor events.
Spin My Party may modify, delay, suspend, relocate, or discontinue operation when the setup area or surrounding conditions are unsafe or unsuitable for the equipment.
8. Outdoor Events & Weather
Outdoor photo booth services require appropriate protection from rain, moisture, excessive wind, extreme temperatures, and other conditions that could damage equipment or create an unsafe environment.
A tent, canopy, permanent roof, or other approved overhead covering may be required.
Spin My Party reserves the right to delay setup, relocate equipment, temporarily stop operation, or discontinue service when weather or environmental conditions pose a risk to guests, staff, or equipment.
The Client should have an alternate indoor or protected location available whenever possible.
Spin My Party will make reasonable efforts to provide the contracted service, but the safety of guests, staff, and equipment takes priority over continued operation.
9. Setup, Breakdown & Rental Time
Spin My Party will make reasonable efforts to arrive with sufficient time to complete setup before the contracted service start time, provided reasonable venue access is available.
Standard setup and breakdown time are not deducted from the Client's contracted rental time.
Customized or elaborate setups may require additional setup and breakdown time. This may include custom backdrops, balloon installations, floral or shimmer walls, specialty décor, multiple equipment pieces, custom props, printing stations, or other personalized enhancements.
The Client is responsible for coordinating with the venue to ensure Spin My Party has adequate access to the event space before the scheduled service start time.
When a customized setup requires additional preparation, Spin My Party may provide the Client with a requested arrival or venue-access time in advance. If the venue cannot provide the necessary access, Spin My Party cannot guarantee that all customized elements will be completed by the scheduled service start time.
Delays caused by the Client, venue restrictions, lack of access, unavailable power, last-minute setup changes, relocation requests, or other circumstances outside Spin My Party's control do not automatically extend the contracted rental period or qualify for a refund.
Additional operating time may be available for an additional fee and is subject to availability.
10. Guest Conduct & Equipment Damage
The Client is responsible for reasonable supervision of guests and for damage to Spin My Party equipment, props, backdrops, displays, accessories, décor, or other property caused by intentional acts, negligence, misuse, theft, or inappropriate guest behavior.
Guests must follow reasonable instructions provided by Spin My Party attendants regarding safe operation of equipment.
Spin My Party reserves the right to immediately pause or stop service if a guest becomes abusive, threatening, excessively intoxicated, repeatedly misuses equipment, or creates an unsafe environment.
The Client may be responsible for the reasonable cost of repairing or replacing damaged, destroyed, or missing Spin My Party property when the damage or loss results from the actions of the Client or the Client's guests.
11. Photos, Videos & Digital Content
Photo booth experiences may produce photographs, videos, GIFs, boomerangs, or other digital content depending on the service selected.
Digital sharing and gallery availability may depend on internet or cellular connectivity at the venue. Poor or unavailable connectivity may delay digital delivery or sharing but does not constitute a failure to provide the photo booth service.
Spin My Party will take reasonable precautions when handling event media but cannot guarantee permanent storage of photos, videos, or other digital content.
Clients are encouraged to download and save any digital content they wish to keep after it becomes available.
12. Promotional Use of Event Content
By participating in a photo booth experience, guests understand that photographs or videos may be created as part of the service.
Spin My Party may use select event photographs or videos for its website, portfolio, social media, advertising, or other promotional purposes unless the Client requests otherwise in writing before the event.
Clients who do not want event content used for promotional purposes should notify Spin My Party before the scheduled event.
13. Custom Designs & Client-Provided Materials
Custom overlays, templates, backdrops, props, signage, printed materials, and other personalized elements may be created based on information provided by the Client.
The Client is responsible for reviewing names, dates, spelling, colors, logos, photographs, and other customized information before final approval when a proof is provided.
Spin My Party is not responsible for errors that were present in Client-provided information or that were approved by the Client during the proofing process.
The Client represents that they have permission to provide and use any logos, photographs, artwork, trademarks, copyrighted materials, or other content supplied to Spin My Party for customization.
14. Equipment Failure & Service Interruptions
Spin My Party maintains and prepares its equipment with the intention of providing reliable service. However, technology and electronic equipment can occasionally malfunction.
If an equipment issue occurs, Spin My Party will make reasonable efforts to troubleshoot, repair, replace, or provide an alternative when reasonably possible.
Spin My Party is not responsible for temporary interruptions caused by venue power failures, internet or cellular outages, venue restrictions, or circumstances outside our reasonable control.
15. Force Majeure & Circumstances Beyond Our Control
Spin My Party is not responsible for failure or delay in performance caused by circumstances beyond our reasonable control, including severe weather, natural disasters, government restrictions, venue closures, widespread power outages, transportation emergencies, or similar unforeseen circumstances.
When reasonably possible, Spin My Party will work with the Client to identify an appropriate solution, including rescheduling when availability permits.
16. Cancellation by Spin My Party
If Spin My Party is unable to provide the contracted service due to circumstances within our control and a reasonable replacement or alternative cannot be provided, the Client will be offered the option to reschedule or receive a refund of amounts paid for the service Spin My Party is unable to provide.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Spin My Party's liability arising from the contracted services will not exceed the amount actually paid by the Client for the affected service.
Spin My Party is not responsible for lost, stolen, or damaged personal property belonging to the Client, guests, venue, or other vendors.
Spin My Party is not responsible for injuries, property damage, service interruptions, or other losses resulting from unsafe guest behavior, venue conditions, power failures, internet outages, or circumstances outside our reasonable control.
Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by applicable law.
18. Privacy
Personal information provided to Spin My Party is used for legitimate business purposes such as processing reservations, accepting payments, providing contracted services, and communicating about events.
Spin My Party does not sell Client personal information.
Please refer to our Privacy Policy for additional information regarding the collection and use of personal information.
19. Governing Law
These Terms and Conditions are governed by the laws of the State of West Virginia.
Any legal proceedings relating to these Terms or services provided by Spin My Party will be handled in a court of competent jurisdiction as permitted by applicable law.
20. Agreement to Terms
By booking services, approving a proposal, signing an agreement, or submitting payment, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
If a signed proposal, invoice, or service agreement contains terms that differ from these general Terms and Conditions, the terms specifically stated in that document will apply to that booking to the extent of the conflict.
